Time Won't Count
Q. I came to New York with my wife. She has an L-1 visa for international transferees. In 1998 I got H-1B and changed jobs only once since then. Will my time here as the L-2 spouse count against the six years I'm allowed here in H-1B temporary professional working status?
A. Your time here as an L-2 won't count against the six years the law allows you to work here in H-1B status. The INS approves H-1B stays for professional workers in up to three year intervals. If you were unemployed or out-of-status between your H-1B jobs, the INS would count that time. After the six years, you'd have to reside abroad for one year before working here again in H-1B status.
